State of the Union: Mizuhara sentencing postponed, Kalshi taking sports bets

Mizuhara sentencing pushed to 6 February

Sentencing for former Shohei Ohtani interpreter Ippei Mizuhara was moved from today (24 January) to 6 February, a California US Attorney’s Office announced yesterday (23 January). Mizuhara in June pleaded guilty to stealing $17 million (£13.6 million/€16.1 million) from Ohtani for illegal sports betting. He faces up to 33 years in prison on counts of bank fraud and subscribing to a fraudulent tax return. Mizuhara will be sentenced by Judge John Holcomb in the US District Court for the Central District of California.

In a 29-pg memo, attorney Michael Freedman wrote that courts routinely “vary downward,” for gambling, adding that Ippei's addiction warrants a variance. He asked the Court to impose an 18-month sentence. A forensic psychologist also supports a downwa..

ICE: California tribes won’t try for wagering legalisation in 2026

On Tuesday (21 January) a panel of California tribal leaders told ICE participants that they won't put legal sports betting on the 2026 ballot. Indian Country has reached some consensus, but polling indicates voters aren't interested.

California Nations Indian Gaming Association (CNIGA) chairman James Siva said that tribes have “come too far and have too far to go to rush into this complex sports betting (issue) which is tied to igaming”. His remarks led a chorus during the ‘State of Gambling in California: Current Trends and Future Prospects’ discussion at the ICE convention in Barcelona.

Siva was joined by Pechanga Band of Mission Indians councilmember Catalina Chacon and San Manuel Band of Mission Indians vice chairman Johnny Hernandez. The panel was the last of four put on by the Indian Gaming Association (IGA). Try, try again: 11 US states don’t have legal wagering; at least four are contenders in 2025

It would be fair to say that the gambling industry would consider 2024 an epic fail in regards to legalisation. No US state expanded gambling of any kind, marking the first year since the Professional and Amateur Sports Protection Act fell in 2018 that that happened.

With 2025 on the horizon, hope springs. Seven years after sports betting became a states’ rights issue, eleven US states have not legalised. It seems likely that at least one – Utah – never will. But what about the rest?

Below is a look at prospects in the 10 other states without legal wagering.

Alabama

In 2024, Alabama lawmakers tried a big lift – the legalisation of everything from lottery to casino to sports betting. All in a state with no gambling, other than electronic bingo on Indian land and historic horse racings at pari-mutuel facilities. The state legislature ultimately gutted and then failed to pass any proposals.

Chris Christie has plenty to say about gambling legalisation. But is he right?

New Jersey's former governor spouted off about chances of legalisation in Texas and California last week. But he's way off the mark.

In an interview with Covers about the state of legal gambling in the US last week, the former New Jersey governor revealed that he is out of touch. Although he and his administration spearheaded the lawsuit that resulted in legal sports betting across the US, Christie would be wise to speak of what he knows.

Or as gaming consultant Brendan Bussmann said: “Texas and California are beasts unto their own and have their own political dynamics, which make them their own markets. This isn’t waving pixie dust on everything and making sports betting happen like one former governor seems to think.”

Tribes, commercial operators aligned against sweepstakes

In a moment that seemed impossible in 2022, on Wednesday (23 October), Indian Country and the Sports Betting Alliance (SBA) in the US had a meaningful conversation about how to fight – together – against sweepstakes.

Victor Rocha invited lobbyist Jeremy Kudon, who represents the SBA (comprised of BetMGM, DraftKings, Fanatics and FanDuel) to share his thoughts on the rise of sweepstakes. That is the latest “unregulated, unlicensed and untaxed” gambling to emerge in the last year.

Sweepstakes offer gaming without initially using real money. In legal sports betting and igaming, consumers stake accounts with cash or cash equivalents. In sweepstakes, the games start off free to play, but then consumers can purchase “coins” or “virtual cash” with which to wager.

Recently, the legal industry has not only taken notice of the rise of sweepstakes, but is starting to educate itself on what they say is already a multi-billion-dollar industry. The goal is to stop it from continuing to prolifer..

Tribes: Sweepstakes the latest threat to sovereignty, exclusivity

Angry and concerned that sweepstakes operators are another existential threat to sovereignty and gaming exclusivity, Indian Country is gearing up for a fight.
“This falls squarely on the tribes again,” Victor Rocha, editor of Pechanga.net, said during his weekly webinar on Wednesday (16 October). “If they don’t react, no one will. We thought it was over, but here we go again. We’re not saying you can’t come into California, we’re just saying that you have to do it through the tribes.

“We will take on that fight anytime, anywhere, anyhow. It’s brand new, it’s right on our platter and we’ll address it.”

Would a 1988 Congress have included digital betting in IGRA? Without a doubt.

Two weeks ago, the US Supreme Court decided to let be the status quo with regard to Florida sports betting. Since then, many in and around the online gambling world are pointing to a sea change and the expectation that tribes across the US will fast and furiously expand or change their offerings. But the view from inside Indian Country? Not so fast.

The US Supreme Court met on 13 June to decide whether to hear West Flagler Associates v. Haaland. The justices decided to pass, meaning a lower-court decision to allow the 2021 Florida-Seminole tribe compact will stand. That compact allows for what could be considered an expansion of the reach of the Indian Gaming Regulatory Act (IGRA).

It allows for bets to be considered placed where they are received. In simple terms, any bet placed in the state of Florida is considered to be a bet placed on tribal lands if the bet runs through a server on tribal lands.

Howe: California sports betting will be done “with and through” state tribes

FanDuel CEO Amy Howe extended an olive branch to California tribes in a panel discussion Tuesday (9 April ) morning at the Indian Gaming Tradeshow & Convention, acknowledging that any future of California sports betting will be done “with and through” tribal operators.

Howe was joined onstage by CNIGA chairman James Siva as well as Jacob Mejia, director of public affairs for Pechanga Development Corporation, both of whom lauded the CEO for being willing to engage in such discussion after the two sides’ previous vitriol.

FanDuel, DraftKings and other commercial operators burned hundreds of millions in 2022 by lobbying for and promoting Proposition 27, an initiative that would have legalised online sports betting in California but was soundly rejected by state voters.
