State of the Union: NY bill proposes dramatic sports betting limits; ECGC review, more

NY assemblyman introduces bill on sports betting limits

A New York assemblyman introduced proposed legislation this week with sweeping restrictions that seek to curtail excessive wagering behaviour.

The bill from Assemblyman Robert Carroll would establish a wagering ceiling of $5,000 (£3,760/€4,389) per day on New York sports betting accounts. It would also limit the number of account deposits a customer can make over a 24-hour period. In addition, the legislation would create restrictions on sportsbook advertising, a point of contention among problem gambling advocates over the last several years.

Underdog Fantasy fined $17.5 million, will withdraw from New York for now

The New York State Gaming Commission (NYSGC) has announced sanctions against Underdog, which it says has been operating unlawfully.

Underdog Fantasy has been offering interactive fantasy sports contests in New York since 22 December 2022 on a temporary fantasy licence held by Synkt, now owned by Underdog. The NYSGC on 14 March found Underdog never had a temporary licence in the state and it therefore could not offer “certain types” of contests.

The commission fined Underdog $17.5 million (£13.49 million, €16.05 million). The number is “based on the amount of revenue Underdog’s popular games generated in New York,” per an Underdog email. Underdog stopped offering games in New York on 14 March.

In a settlement, the NYSGC wrote that Underdog “asserts that it [had] operated in New York since 22 December 2022 under a good-faith belief that it had the ability to do so lawfully”. Underdog, according to the settlement, does not “accept or admit” any wrongdoing.

Season-long props, sports awards betting approved by NY senate committee

The New York state senate passed a bill that legalises a new kind of proposition bets and some awards wagers.

In a bill sponsored by New York state senator Joseph P Addabbo Jr, the committee voted on Tuesday (11 February) to amend the racing, pari-mutuel wagering and breeding law. SB 2616 would allow for betting on season-long proposition and future award winners, such as the Heisman Trophy. It would also add betting on pre-game coin tosses.

The bill passed unanimously. From here, it will continue moving through the senate. It must pass the house and get Governor Kathy Hochul’s signature before it could become effective.

According to the text of the proposal, allowing for season-long proposition bets and predicted award winners would “expand on an already successful” online sports betting product.

The New York bill noted that the state was “quickly become the leading market for mobile sports”. Adding that this was bringing in revenue for education in the state.

Sportsbook+ could be DraftKings’ tax saviour. But in the era of subscriptions, will consumers add one more?

On 28 December, DraftKings quietly launched a new subscription service, dubbed DraftKings Sportsbook+, for select customers located in New York. The new service, which allows for odds boosts on parlays, is the first of its kind – and it could be the company's tax saviour. But will bettors actually subscribe?

Essentially, Sportsbook+ allows subscribers to get better odds on parlays. Each applicable parlay must be at least two legs and each leg must have odds of -500 or narrower. For each leg added to the parlay, the odds would be improved by 10%. In other words, a two-leg parlay would be boosted 10%, a three-leg bet would be boosted 20% and so on. Parlays with 11 or more legs would be boosted by 100%, or double the original payout. The maximum applicable bet is $25.

New York sets $231.6 million online sports betting revenue record in November

Mobile sports betting gross gaming revenue in New York reached a monthly record of $231.6 million (£181.6 million/€219.0 million) during November, while handle fell just short of the state’s all-time high.

Revenue from online sports betting was 53.5% higher than $150.9 million in November last year. It also surpassed the $176.3 million posted in New York in October this year by 31.4% and beat the state’s existing record – $211.5 million in January – by 9.5%.

Spending-wise, data from the New York State Gaming Commission reveals monthly handle for November hit $2.27 billion. This is the second-highest monthly amount on record since the state launch legal online betting in January 2022.

November’s handle total is 7.6% more than last year but fell 2.2% short of October’s record $2.32 billion spend. As for hold, the state-wide total for the month was 10.22%, a marked improvement from 7.60% in October.

Jontay Porter co-conspirator pleads guilty

Former professional poker player Long Phi Pham, who conspired with ex-NBA player Jontay Porter and two others in a sports betting scam, on Wednesday (2 October) agreed to plead guilty to one charge of conspiracy to commit wire fraud.
Pham appeared in the US District Court for the Eastern District of New York. He was released on a bond of $750,000 (£571,450/ €680,062) and will be sentenced 25 April 2025. Pham, Jontay Porter and two others were set to win more than $1m total after the Toronto Raptors player agreed to remove himself early from two games earlier this year. But DraftKings flagged the outsized player-prop bets, and an investigation ensued.

NBA commissioner Adam Silver in April banned Porter for life. Three months later, he pleaded guilty to conspiracy to commit wire fraud in July and is awaiting sentencing. Federal prosecutors recommended a sentence of 41-51 months in jail. Porter was released on $250,000 bond and his sentencing is set for 18 December.

Gambling advertising laws tightened in New York

The bill ensures all forms of wagering, including online, will carry responsible gambling messaging.
In a move aimed at addressing the growing concerns over gambling addiction, New York’s governor, Kathy Hochul, signed into law new legislation that mandates stronger warnings in gambling and sports betting advertisements. The legislation, S1550/A1118, requires all gambling-related advertisements, including those for mobile sports wagering, to include clear warnings about the potentially harmful and addictive effects of gambling.

This move expands on previous regulations. New York previously required only the display of a problem gambling hotline number and didn’t cover online gambling.

The legislation also mandates that the New York State Gaming Commission collaborate with the Commissioner of Addiction Services and Supports to ensure that all gaming-related advertisements prominently display a hotline for problem-gambling assistance.

ESPN Bet now live in New York

Penn Entertainment launched ESPN Bet in its biggest market yet on Friday (27 September) when it went live in New York state. The platform is now available in 19 US jurisdictions.
The platform, a partnership between the casino company and ESPN, went live in 17 US jurisdictions in November 2023. Prior to Friday’s New York launch, Pennsylvania was the biggest state in which the platform was live.

The New York launch was later than Penn executives had pointed to, as CEO Jay Snowden said he was hoping for a late August launch during the company’s second-quarter earnings call in early August. But the New York State Gaming Commission (NYSGC) didn’t have a meeting at which to approve the application until 23 September.

ESPN Bet aiming to launch within days after getting NYSGC licence approval

On Monday (23 September) the New York State Gaming Commission (NYSGC) voted to transfer the Wynn Resorts digital sports betting licence to Penn Entertainment. This means that ESPN Bet could be live in the state by the weekend.
Penn Entertainment and ESPN have been waiting for the vote and the go-ahead to launch. Executives from both companies had previously pointed to a launch by the end of August. But the NYSGC declined to call a special meeting to vote and the last meeting was in June.

The state of New York has a cap of nine digital wagering licences. All nine were accounted for at the beginning of 2024, but WynnBet decided to get out of the digital betting business and exited the state in July. In February, Penn made a deal to buy WynnBet’s NY licence for $25m (£18.7m/€22.5m).

ESPN Bet about to get closer to NY launch?
The New York State Gaming Commission Monday (23 September) will consider Penn Entertainment’s application to take over the WynnBet New York licence. The plan has been in the works since WynnBet exited the New York market earlier this year. Should Penn get approval, it will be able to launch its ESPN Bet platform in the biggest competitive market in the US. New York law caps the number of platforms at nine. Licences only come available if a company exits the state.

Penn executives on the company’s second-quarter earnings call pointed to a September launch, potentially by the start of football season. Should the regulator approve the licence transfer, Penn will still have a few steps to take before it could launch ESPN Bet.

Tax Foundation research bears out diverse US wagering tax rates, barriers to entry

On Tuesday (17 September) the Tax Foundation released an interactive map that shows tax rates for every legal US online sports betting jurisdiction. The map reveals the diverse tax structures that exist across the country.
Operators must deal with separate sets of laws, regulations and tax structures in each jurisdiction in which they are licensed.

The map does not include the fees that operators must pay in each state. But according to the press release, high licensing fees are among the “common barriers” to entry. It uses as examples Massachusetts, which has a $5m (£3.8m/€4.5m) initial fee and $5m renewal every five years and Pennsylvania, which has $10m initial fee and $250,000 annual renewal.

New York, which is capped at nine operators, has the highest initial fee at $25m. In part because of that, only major US or global platforms are available in the state.

Judge denies Jontay Porter’s request for his passport so he can play pro ball in Greece

On Tuesday (16 July), banned NBA player Jontay Porter filed a motion to get his passport back before sentencing in an NBA sports betting scandal, so he can play basketball in Greece. A district court judge denied the motion.

The motion, filed by Porter in the US District Court for the Eastern District of New York, included four requests:

1. for Jontay Porter to get his passport back;

2. to travel to and around Europe;

3. to live in Patras, Greece; and

4. to play pro basketball in Patras, Greece.

Porter last week pleaded guilty to felony charges and admitted to being part of a gambling scandal in which he removed himself from two NBA games so others could win their bets. Four others have been charged in the scandal.

Porter is set to be sentenced in December. Federal prosecutors are recommending that he serve 41-51 months in prison. He’ll also have to pay more than $450,000 in fines and fees.

Porter was released on $250,000 bond put up by his wife and mother.
